Terms of Service

These Terms of Service ("Terms") govern your use of the Faithful Song Maker mobile app and this website (together, the "Service"), provided by LA Interactive LLC ("we," "us," or "our"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or guardian, who agrees to these Terms on your behalf.

2. The Service

Faithful Song Maker turns the words you write into songs using artificial intelligence. Songs are generated automatically. Results vary, may contain mistakes, and may not always match what you intended. The Service is offered for personal inspiration and enjoyment. It is not a substitute for pastoral, medical, or professional advice.

3. Your content

You keep ownership of the text you write ("Your Input"). You give us a worldwide, non-exclusive, royalty-free license to use, store, and process Your Input and the songs created from it in order to operate, provide, and improve the Service, including sending it to the AI service providers described in our Privacy Policy.

You are responsible for Your Input. You confirm that you have the right to submit it and that it does not violate anyone's rights or any law.

4. Your songs

Subject to these Terms and the terms of our AI providers, you may play, download, and share the songs you create for personal, non-commercial purposes, such as sharing with family, friends, and your church community. Because songs are generated by AI, we cannot guarantee that a song is unique or that it is eligible for copyright protection. For any commercial use, contact us first at team@lainteractive.co.

5. Sharing

When you share a song, anyone with the link can listen to it and see its title, style, and lyrics. You are responsible for what you choose to share. Deleting a song from your Library disables its share link.

6. Acceptable use

You agree not to use the Service to:

• Create content that is unlawful, hateful, harassing, threatening, sexually explicit, or that promotes violence.
• Infringe anyone's copyright, trademark, privacy, or other rights, including submitting lyrics you do not have the right to use.
• Impersonate any person or misrepresent the origin of a song.
• Interfere with, overload, scrape, or attempt to gain unauthorized access to the Service.
• Reverse engineer the app, or resell or redistribute the Service.

We may remove content or limit access to the Service if we believe these rules have been broken.

7. Subscriptions and payments

• Some features require a paid subscription. Prices and plans are shown in the app before you buy.
• Payment is charged to your Apple App Store or Google Play account when you confirm your purchase.
• Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends. Your account is charged for renewal within 24 hours before the period ends.
• If a free trial is offered, any unused portion is forfeited when you buy a subscription. If you do not cancel before the trial ends, the subscription starts and you are charged.
• You can manage or cancel subscriptions in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
• Refunds are handled by Apple or Google under their policies.

8. Our intellectual property

The Service, including the app, website, name, logo, design, and software, belongs to LA Interactive LLC and its licensors. You may not copy or use them except as needed to use the Service as intended.

9. Third-party services

The Service relies on third parties, including app stores and AI providers. Your use of the app stores is also governed by their terms. We are not responsible for third-party services.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted or error-free, or that songs and files will always be available.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LA INTERACTIVE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify and hold harmless LA Interactive LLC from any claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Input, your use of the Service, or your violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or end your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. We will first try to resolve any dispute informally through good-faith discussion for 30 days. After that, disputes will be resolved in the state or federal courts located in Delaware.

15. Apple-specific terms

If you downloaded the app from the Apple App Store, these Terms are between you and LA Interactive LLC, not Apple. Apple is not responsible for the app, its maintenance or support, or any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. If you keep using the Service after changes take effect, you accept the updated Terms.

17. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
